Shropshire delivery drivers should heed warning
Shropshire delivery drivers have been warned they could be found guilty of dangerous driving – even if they’re not in their vehicle.

The message comes from Tony Conlon at Henshalls Insurance Brokers in Newport and Shrewsbury, who said their employers could also be prosecuted if an employee was convicted.
“It sounds incredible, but drivers really could be prosecuted if an accident occurs involving their vehicle even if they were not in it at the time.”
Tony said the warning followed a court case where a driver delivering building supplies had to park on a main road, leaving his hazard lights on and the engine running.
“He parked the vehicle near a right-hand bend on a single carriageway and so drivers travelling in the same direction had to drive round his vehicle, crossing double white lines.
“A number of drivers had difficulties, including one who had to make an emergency stop to avoid hitting the delivery vehicle. And after about ten minutes, a driver was killed instantly when his van hit the stationary vehicle at between 50 and 60 mph.
“The delivery driver was charged with causing death by dangerous driving and received a 15-month jail sentence and was banned from driving for two years.
“Three judges agreed that he had caused an unnecessary hazard which was bordering on the dangerous and they rejected his defence that he wasn’t actually driving at the time of the accident.
“This case is important for all drivers, and for employers who send staff out on work-related journeys, particularly where deliveries are being made.
“And no matter whether they agree with the verdict, employers must be aware they could be liable for prosecution too if any of their staff was convicted of a similar offence.
“Just because the driver is not behind the wheel, the vehicle is still their responsibility, wherever it is parked, at all times – it’s a warning that must not be ignored.”
